Submission of an order is expressly made conditional on purchaser's assent to the Terms and Conditions set forth below, and in the event any of such Terms and Conditions conflict with the Terms and Conditions contained in purchaser's order, the conflict will be resolved in favor of the Terms and Conditions set forth below.


Payment Terms

For purchasers with established credit, payment terms are net 30 days from date of shipment. We accept Visa, MasterCard, and American Express. Government agency purchase orders accepted. If an open account purchaser fails to make full payment within thirty (30) days from date of shipment, Tanner Bolt & Nut Corp. may defer any further shipments or other orders or cancel any portion of an unshipped order. Tanner Bolt & Nut Corp. reserves the right to charge interest at the rate of 18% per annum (1.5% monthly) or at the highest rate available under applicable law, to any account balance exceeding the terms set forth herein. It is understood and agreed that purchaser will pay, to the extent permitted under law, all reasonable costs and expenses, including attorney's fees and costs incurred by Tanner Bolt & Nut Corp. in connection with any collection action for payment of the amounts due herein.


Freight

Shipping is FOB Brooklyn, New York. Freight charges will be added to the invoice. Free shipping is available in certain areas. All products shipped will be carefully examined, counted and shipped. No claim for shortages will be allowed unless made in writing within five (5) business days after receipt by the Purchaser.

Please note that additional carrier fees, such as Limited Access, is the responsibility of the recipient and we will automatically bill the card used. Any overages like this are the responsibility of the receiver unless it is our error.

Limited access is defined as meeting any of the following conditions: Not open to the walk-in public during normal business hours. Not having personnel readily available to assist with the delivery or pickup function. Not having access to loading dock or platform. Such as but not limited too

  • Churches
  • Military bases/locations
  • Store Fronts/ Strip malls / Malls
  • Construction Sites
  • Self Storage locations
  • Hotels
  • Country Clubs
  • Hospitals
  • Farms
  • Funeral Homes/Cemeteries

Acceptance of Goods and Returns

All products shall be deemed accepted by the purchaser at the time of delivery. The seller will not accept the return of any products without prior authorization. A restocking charge may apply to authorized returns. Special, non-standard, and made-to-order products (either published or unpublished) are noncancelable/non-returnable. Products will not be accepted for return after 30 days from the date of delivery to the Purchaser. Any cancellation or returns may be subject to a restocking fee and other charges, for which the Purchaser shall be responsible.


Taxes

The amount of taxes applicable to the sale of material shall be added to the purchase price and shall be paid by the buyer, unless buyer provides seller with an exemption certificate acceptable to the taxing authorities


Product Application

Seller’s products are intended for installation as illustrated or described on this website. In no event will Tanner Bolt & Nut Corp.be responsible for any loss or damage arising out of the Purchaser's improper selection, misapplication or misuse of a product. Tanner Bolt & Nut Corp. shall in no event be liable for any breach of warranty in an amount exceeding the purchase price of the goods.

Limitation of Liability

Tanner Bolt & Nut Corp. expressly disclaims all warranties, express or implied, of any kind with respect to products contained herein, including but not limited to, merchantability and fitness for a particular purpose. The sole and exclusive maximum liability to Tanner Bolt & Nut Corp. arising from any product sold shall be the price of the product ordered and actually paid. In no event shall Tanner Bolt & Nut Corp., its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to the product sold.


Applicable Law and Venue

Any purchases made from Tanner Bolt & Nut Corp. shall be deemed contracts made in the United States, State of New York. All questions pertaining to the validity, construction, execution and performance of such contracts shall be construed and governed in accordance with the domestic laws of the State of New York (including, without limitation, the UCC), without giving effect to principles of conflicts of law. Any action commenced in connection with the contract shall be brought in a federal or state court located in the United States of America, State of New York, County of Kings, and to the extent not otherwise subject to the jurisdiction of such courts, Purchaser agrees to waive any objection to such jurisdiction and to subject itself to the jurisdiction of such courts.
